Agreement Overview

This agreement explains the basic terms and conditions for using the SoftonHost website (the “Site”) and accessing or purchasing the products and services we offer (collectively, the “Services”). It works alongside any specific terms that might apply to certain Services. By browsing our Site, using its features, or purchasing anything we provide, you’re agreeing to follow this agreement and all related policies, including specific product agreements.

When our Services involve handling personal data, we’ll do so according to our Privacy Policy and, if necessary, a Data Processing Addendum (DPA). These documents are part of this agreement, too.

Our Site and Services are designed for professional and business use. By using them, you’re confirming that your purpose is professional or commercial in nature.

Throughout this agreement, “we,” “us,” or “our” refers to SoftonHost, and “you,” “your,” “User,” or “Customer” refers to anyone who accepts these terms, sets up an account, or uses the Services. This agreement does not create any rights for third parties.

We may update this agreement or our policies at any time, and those changes will take effect as soon as they’re posted on the Site. If you continue using the Site or Services after an update, it means you accept the new terms. If you disagree, you’ll need to stop using the Site and Services. Occasionally, we’ll notify you of updates via email, so it’s important to keep your account information, including your email address, accurate and current. We aren’t responsible if you miss notifications because your details were out of date.

Eligibility and Authority

Our Site and Services are only available to people who can legally enter into binding agreements. By using them, you confirm that:

  • You’re at least 18 years old.
  • You’re legally allowed to form binding agreements under the law where you live.
  • There’s no law in your area preventing you from using or accessing our Services.

If you’re acting on behalf of a business or organization, you confirm that you have the authority to bind that entity to this agreement. If we find out you don’t have the necessary authority, you’ll be personally responsible for meeting the obligations in this agreement.

We aren’t responsible for following instructions or communications that we believe are coming from authorized representatives of your organization.

You’re also agreeing to be responsible for all actions taken by you, your agents, or anyone using your account, whether they had permission or not.

Sanctions Compliance

By using our Services, you guarantee that:

  • You’re not living in, and won’t use or distribute our Services in, any country or region under comprehensive sanctions (e.g., Cuba, Iran, North Korea, Russia, Syria, certain parts of Ukraine, Belarus, Venezuela, or other areas restricted by U.S., E.U., or U.N. sanctions).
  • You’re not on any government sanctions lists (like the U.S. OFAC or E.U. sanctions lists).
  • You’re not owned or controlled by someone on those sanctions lists.

If your situation changes—like being added to a sanctions list—you must let us know immediately and cooperate fully with any compliance checks. If we suspect a sanctions violation, we can end your access to our Services without prior notice. You also agree to cover any losses or issues SoftonHost faces because of your failure to follow sanctions rules.

Accounts and Data Transfers

Accounts

To access some features, you’ll need to create an account with accurate and up-to-date information. It’s your responsibility to keep your login details secure. You’re fully responsible for anything that happens under your account, even if it wasn’t you. If there’s a security breach, let us know right away.

You may also be responsible for any damages caused by the actions taken through your account, whether accidental or intentional.

Data Transfers

If you’re accessing our Site from outside the region where our servers are located, your data (including account details) might be transferred internationally. By using the Site, you agree to these transfers.

Account Sharing

You can allow others to access your SoftonHost account by assigning them permissions. However, you’re responsible for their actions and any harm they might cause. We’re not responsible for resolving any disputes about shared account access.

 AVAILABILITY OF WEBSITE/SERVICES

Subject to the terms and conditions of this Agreement and our other policies and procedures, we shall use commercially reasonable efforts to attempt to provide this Site and the Services on a twenty-four (24) hours a day, seven (7) days a week basis. You acknowledge and agree that from time to time this Site may be inaccessible or inoperable for any reason including, but not limited to, equipment malfunctions; periodic maintenance, repairs, or replacements that we undertake from time to time; or causes beyond our reasonable control or that are not reasonably foreseeable, including, but not limited to, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion, or other failures. You acknowledge and agree that we have no control over the availability of this Site or the Service on a continuous or uninterrupted basis, and that we assume no liability to you or any other party with regard thereto.

From time to time, SoftonHost may offer new Services (limited preview services or new features to existing Services) in a pre-release version. New Services, new features to existing Services, or limited preview services shall be known, individually and collectively, as “Beta Services.” If you elect to use any Beta Services, then your use of the Beta Services is subject to the following terms and conditions:

  1. You acknowledge and agree that the Beta Services are pre-release versions and may not work properly.
  2. You acknowledge and agree that your use of the Beta Services may expose you to unusual risks of operational failures.
  3. The Beta using them in production or mission-critical environments.
  4. SoftonHost reserves the right to modify, change, or discontinue any aspect of the Beta Services at any time.
  5. Commercially released versions of the Beta Services may change substantially, and programs that use or run with the Beta Services may not work with the commercially released versions or subsequent releases.
  6. SoftonHost may limit the availability of customer service support time dedicated to supporting the Beta Services.
  7. You acknowledge and agree to provide prompt feedback regarding your experience with the Beta Services in a form reasonably requested by us, including information necessary to enable us to duplicate errors or problems you experience. You acknowledge and agree that we may use your feedback for any purpose, including product development purposes. At our request, you will provide us with comments that we may use publicly for press materials and marketing collateral. Any intellectual property inherent in your feedback or arising from your use of the Beta Services shall be owned exclusively by SoftonHost.
  8. You acknowledge and agree that all information regarding your use of the Beta Services, including your experience with and opinions regarding the Beta Services, is confidential and may not be disclosed to a third party or used for any purpose other than providing feedback to SoftonHost.
  9. The Beta Services are provided “as is,” “as available,” and “with all faults.” To the fullest extent permitted by law, SoftonHost disclaims any and all warranties, statutory, express or implied, with respect to the Beta Services, including, but not limited to, any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement.

You acknowledge and agree that you have the necessary rights and permissions to share all information necessary to provide the Services with SoftonHost. You acknowledge and agree that the Services may be provided by independent contractors or third-party service providers. All paid support services are non-refundable.

The Services do not support all local languages. If a local language is not supported, then the Service will default to English only. To the extent that the Services are used with a local language (other than English) or in a certain country, there may be limitations to certain features or functionality within the Service or services provided by third parties (e.g., payment methods).

MONITORING OF CONTENT; ACCOUNT TERMINATION POLICY

SoftonHost generally does not pre-screen user content, whether posted on websites hosted by SoftonHost or directly on this site. However, SoftonHost reserves the right (without obligation) to review and decide whether any user content is appropriate and complies with this agreement. If any content violates this agreement or is deemed inappropriate (at SoftonHost’s sole discretion), SoftonHost may remove it and/or terminate a user’s access to this site or its services, without prior notice.

SoftonHost may also terminate a user’s access to this site, its services, or their account without notice if:
(i) It becomes aware of activities involving child exploitation, terrorism, or similar harmful content.
(ii) It believes the user is a repeat offender.

If SoftonHost terminates your access, it may, at its discretion, delete all data and files stored on its servers, including backups. Using any of SoftonHost’s services for illegal activities automatically grants SoftonHost the right to terminate your account.

ADDITIONAL RESERVATION OF RIGHTS

SoftonHost reserves the right to deny, cancel, suspend, lock, or modify access to any account or service for reasons that include but are not limited to:
(i) Correcting errors in service delivery or domain registrations.
(ii) Protecting network integrity and stability.
(iii) Preventing fraud or abuse.
(iv) Complying with legal obligations, law enforcement requests, or dispute resolutions.
(v) Avoiding liability in potential legal matters.

SoftonHost also reserves the right to terminate any services if users engage in harassment or threats toward its employees. Furthermore, SoftonHost may access or modify your account to assist you during customer service interactions. SoftonHost is not liable for any data loss resulting from such actions.

NO SPAM POLICY

SoftonHost does not tolerate spam. Traffic to and from its servers is monitored, and any suspected spam activity will be investigated. SoftonHost defines spam as unsolicited communications, including:

  • Emails, newsgroup posts, or system messages.
  • Pop-ups, instant messages, or advertisements in chatrooms.
  • Guestbook or forum posts.
  • Text/SMS or fax solicitations.

Using SoftonHost’s services for spam violates this policy. Commercial emails or faxes are only permitted if recipients have opted in. These communications must include a valid return address, physical sender address, and opt-out options. Proof of opt-in may be requested.

Suspected spamming activity may result in service suspension, redirection, or termination. Repeated violations can lead to account termination. Reports of abuse can be sent to.https://softonhost.com/contact-us/

TRADEMARK AND COPYRIGHT CLAIMS

SoftonHost supports intellectual property rights. To report trademark or copyright violations, please refer to SoftonHost’s Trademark and Copyright Infringement Policy.

LINKS TO THIRD-PARTY WEBSITES

SoftonHost’s site and services may include links to third-party websites not owned or controlled by SoftonHost. It is not responsible for their content, policies, or practices. By using SoftonHost, you release it from liability related to third-party websites. SoftonHost encourages reviewing the terms and policies of any third-party sites you visit.

AUTOMATED CONTENT

SoftonHost may use AI tools for content creation, such as generating text, logos, or business names. You are responsible for reviewing any AI-generated output to ensure compliance with laws and intellectual property rights. Do not upload sensitive personal data, as SoftonHost may use input data to improve its tools. SoftonHost does not guarantee the accuracy or originality of AI-generated content.

LIMITED WARRANTIES

SoftonHost provides its services “as is” and “as available.” It disclaims all warranties, express or implied, including those of merchantability, fitness for a particular purpose, and non-infringement. SoftonHost is not liable for:

  • Accuracy or content of its services or linked sites.
  • Loss of business, data, or any other damages.
  • Unauthorized access or service interruptions.

Any advice from SoftonHost’s employees or representatives does not constitute a warranty.

LIMITATION OF LIABILITY

SoftonHost is not liable for direct, indirect, or consequential damages, including:

  • Loss of data, business, or profits.
  • Unauthorized access or malicious activity.
  • Service interruptions or software issues.

Total liability is limited to the amount paid for services within the 12 months preceding the incident or €10,000, whichever is less.

INDEMNITY

You agree to protect and hold SoftonHost, its employees, and partners harmless from claims or liabilities arising from your use of its services or violations of this agreement. This obligation continues after the termination of your account or services.

Discontinued Services; End of Life Policy

SoftonHost reserves the right to stop offering or providing any of its Services at any time, for any reason, or even no reason at all, without prior notice. While SoftonHost strives to extend the lifespan of all its Services, there are instances when a Service we offer may be discontinued or reach its End-of-Life (EOL). In such cases, that Service will no longer be supported by SoftonHost in any way, effective from the EOL date.

Notice and Migration: If any Service we offer has reached or is about to reach its EOL, we will make an effort to notify you at least thirty (30) days before the EOL date. It will be your responsibility to take the necessary steps to replace the Service by migrating to a new one or discontinuing reliance on the Service before the EOL date. In either case, SoftonHost may offer a comparable Service for you to migrate to for the remainder of your purchase, provide a prorated in-store credit, or issue a prorated refund, at SoftonHost’s sole discretion.

Fees and Payments

You agree that your Payment Method may be charged by one of our affiliated entities. If your payment is processed in a specific region, your transaction will be handled by the corresponding

(A) General Terms, Including Automatic Renewal Terms

By purchasing our Services, you agree to provide accurate and complete payment information (including any tax exemptions such as VAT/GST number). Any claims or requests should be submitted within 30 days of your purchase unless otherwise required by law.

If you use automatic payments, you must have a primary payment method and may also add a backup payment method. If the primary method fails, the backup method will be used to ensure continuous service.

You agree to pay all prices and fees for Services purchased at the time of order. All prices and fees are non-refundable unless stated otherwise in our Refund Policy. SoftonHost reserves the right to modify prices and fees at any time, with immediate effect upon being posted on our site. These changes will apply at the time your Services come up for renewal.

Services may be paid for through a valid credit card, PayPal, or in-store credits, where applicable. If you use “Express Checkout,” clicking the button will automatically place an order and charge your primary Payment Method.

Your payment method must remain valid to avoid service interruption. If a refund is issued, SoftonHost cannot control when it will reflect in your bank account, as processing times depend on your payment provider.

Services that offer automatic renewal will renew for the same period as the original service, unless otherwise specified. SoftonHost may notify you of upcoming renewals but is not obligated to do so. You are responsible for checking and managing renewal settings in your account.

If your payment fails or a chargeback occurs, SoftonHost may take legal action to recover the owed amount, which may include cancellation of services and domains. Administrative fees may apply for non-compliance or additional services, such as legal disputes or chargebacks.

Refund Policy:

Refund-eligible products 

Refund-eligible products and services can be refunded within thirty (30) days of purchase. For products including a free domain name, the list price for the domain will be deducted from the refund. You will not be eligible for more than one refund for the same product.

(B) Pay by PayPal

By choosing PayPal, you authorize SoftonHost to debit the full purchase amount from your PayPal account or linked funding sources. You are responsible for maintaining a funded PayPal account. If PayPal fails to process payment, SoftonHost may take legal action to collect the owed amount. If the transaction is returned unpaid, you will incur a service charge.

By agreeing to the PayPal terms, you authorize the payment from your account, acknowledging that PayPal or SoftonHost may take appropriate steps to recover payment if the transaction is declined.

(C) International Payment Options

For international payments, you may choose a variety of payment providers (IPP). By selecting an IPP, you agree to the terms of service of the IPP. SoftonHost will process your payment only once it is confirmed by the IPP. Any delays in payment confirmation may result in order cancellation, requiring a new purchase process. Refunds, if applicable, may be processed to your funding source, minus any IPP fees.

(D) IN-STORE CREDIT BALANCES

If your account holds an in-store credit balance, you may use that balance towards any future purchases or services you get from us. By maintaining an in-store credit balance, you also allow SoftonHost to apply this balance to any outstanding administrative fees, chargebacks, or other account-related fees. If your primary payment method fails during automatic billing for service renewals, and there’s enough in-store credit available, we may apply that credit to cover the full cost.

Please note, however, that we’re not responsible for losing any products or services if we can’t collect funds due to issues with your primary payment method or available in-store credit. When using your in-store credit, the balance will be applied according to the currency you selected when checking out. If you have multiple credits, we will apply them starting with the oldest one first. If extra funds are needed to complete a purchase or renewal, we will convert credits in other currencies at SoftonHost’s daily exchange rate (starting with the oldest credit), and there may be additional conversion fees.

You can always check your available credit by logging into your account or viewing your cart. Remember, in-store credits are non-transferable, expire after two years if complimentary, and can only be used within the account they were issued. If we close your account, any remaining credits will be forfeited.

(E) Cryptocurrencies, Tokens, and Digital Assets

We want to make it clear that if the CPP declines a transaction for any reason (for example, due to insufficient funds in your account), neither the CPP nor SoftonHost will be held liable for any issues that arise. We will not fulfill your purchase until we’ve received payment confirmation from the CPP, which may take anywhere from a few hours to several days. If we don’t receive confirmation within 30 days, your order may be canceled, and you will need to start the purchase process again.

COMPLIANCE WITH LOCAL LAWS

SoftonHost does not guarantee that the content or services available on this site are suitable for every country or jurisdiction. If you’re accessing this site from a country where the content is illegal, you’re responsible for ensuring compliance with all applicable local laws and regulations.

GOVERNING LAW; JURISDICTION; VENUE; WAIVER OF TRIAL BY JURY

Except for any disputes governed by the Uniform Domain Name Dispute Resolution Policy, this Agreement will be governed by the federal law of Cyprus. You agree to waive your right to a trial by jury for any disputes arising out of this Agreement.

TITLES AND HEADINGS; INDEPENDENT COVENANTS; SEVERABILITY

The titles and headings in this Agreement are for convenience only and should not affect the interpretation of any provisions. Each part of this Agreement is independent of the others. If a court finds any part of this Agreement to be illegal, invalid, or unenforceable, the rest of the Agreement will remain in effect to the fullest extent allowed by law.
